Donald Trump's Regime of Consequences and Incentives

The ex-president's voracious urge for payback has swiftly evolved into a organized apparatus. During the past year, the chief executive's fury and whims have adopted the shape of official policies in a manner comparable to past dictatorial governments. Justice department personnel who resist his demands are summarily removed and replaced by loyalists. Critical leaders who challenge him face legal action, trial and penalties. Adversaries have been labeled under administration directives as “unpatriotic”, “opposed to religious values” and “anti-capitalist”, and warned with criminal charges as “security threats”.

Government Institutions Remade

Every instance involving legal action of critics and protection for supporters displays its own distinct qualities. Yet, despite their particular nature, they represent expressions of what has developed as a deliberate method. Such episodes are not isolated. Trump's cleansing of federal lawyers and law enforcement personnel, coupled with his placement of loyalists in key positions, started quickly, soon took on a consistency, and has now been formed into a system. DoJ and the FBI have been remade into political bodies under the president's direct command to carry out his wishes. Unfairness has been rendered normal. It constitutes the apparatus of revenge.

Leadership is more concerned with penalizing the President's supposed adversaries than they are with safeguarding our national security.

Inside the Structure

The beginnings of this framework has been exposed in the legal complaint of three ex- high-ranking Federal Bureau officials filed in the ninth month in the judicial system in Washington against agency head Kash Patel and justice department head another official for illegal termination in “a initiative of revenge against the officials for what the accused considered to be a refusal to exhibit sufficient political loyalty”. In the complaint that Brian Driscoll, the former temporary head, details a conversation in which Patel “freely confessed the impropriety of his conduct”.

Driscoll had sought to shield FBI agents from being dismissed, the filing alleges. He informed him that “administration officials” – understood by the official to be the presidential administration and federal prosecutors – had directed him to remove all those who they identified as having worked on a legal probe against him. The document continues: “He stated that he had to fire the individuals his bosses told him to remove, because his chance to retain his own role depended on the removal of the officials who handled cases involving the leader. Patel commented that there was no way he or the official could do to stop these or any other dismissals, because ‘the agency sought to incarcerate the chief in prison and he recalls it clearly.’” Once he informed the director he was breaking the bureau's own internal rules, the director reportedly said “he recognized that and he was aware the essence of the swift terminations were probably improper”.

Broad Consequences

After Patel's alleged admission to him, the Department of Justice and the Federal Bureau have been weakened and reorganized for Trump's system of punishment. Six of the agency's top officials were dismissed or pushed out in the early weeks of the government. About thousands of legal professionals at DoJ have taken a “early exit scheme”. No fewer than seven federal prosecutors, among them those in the New York office, stepped down in objection over what they viewed as ideological pressure in dropping the criminal prosecution against the city leader, Eric Adams, in return for his collaboration with Trump's federal agency arrests of foreign nationals. The anti-corruption unit of the department, which oversees ethical violations, has been reduced to two attorneys. The equality section has been severely reduced: 70% of its personnel has left. A third of senior leaders at the justice department have resigned. The unit upholding environmental law has seen departures of half its leadership.

Favors and Sanctions

Regarding the legal matter, the interim prosecutor for the southern district of New York, the official, stepped down in dissent against what she described as the “exchange”. A key figure, his “border czar,” appeared as the implementer with Adams on Fox News to declare: “Should he fail to deliver, I'll be back in New York City.”. And, a former official, previously the acting deputy attorney general and a ex-lawyer, who arranged the agreement, was granted an court role, a potential pathway to the highest court.

Trump's protection for crimes committed while in government, awarded by the unprecedented decision of the GOP-led on the supreme court, thus thwarting his prosecution over the Capitol riot and preserving his public standing for the 2024 election, is the foundation stone on which he depends to defend his stalwarts. Under these circumstances, he has been freed to enable misconduct. The effect of the supreme court decision saturates his government and the GOP thoroughly. The legal case has escalated. As the former president's legal adviser the figure said about the Watergate
