The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the introduction of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been contained. A Washington representative spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its retaliation: an extensive attack of rocket attacks on Kyiv.

The Rhythm of Diplomacy and Destruction

The succession of contrasting events captured the harsh reality of the recent timeframe. By day, negotiation efforts are fought: optimistic declarations are delivered from various governments. Significant resources is devoted on managing particular approaches. By night, Moscow brutally reminds the world that, for them, military action persists as the key method for achieving "resolution".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is equipped to monitor missile launches from Russian territory, a capability enabled by current data. From observation points, Ukrainian air force fighter jets that had been dispatched to intercept incoming aerial threats flew past – modern combat jets supplied to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems engaged: multiple launches deployed against a hostile projectile. This was a sophisticated defense system at work, presumably supplied through allied countries. Every deployment jolts you unexpectedly, shaking the windows. The moment of terror quickly becomes resigned acknowledgment: maybe the hostile projectile won't cause damage this time, preventing destruction from devastation and additional electricity failures.

Ongoing Risks

Not long after, a automatic firearm fired at a unmanned aircraft close by, part of a rapid response unit – almost certainly Western-made equipment. Sadly, the bullets missed the enemy aircraft – it maintained course toward its objective.

Intermittently, this persisted until dawn. Kyiv greeted the early updates: multiple fatalities, destruction and utility failures in many homes as a result of the night's assault. As typically, everyone still went about their day – living the war. But those 24 hours illustrated Ukraine's vital need on international aid – a dependence that regional partners are clearly incapable to replace in the short term.

Failed Diplomacy

The 28-point plan from American leadership generated strong feelings, discussion and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and bilateral conferences.

Every new approach from American administration unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually secure success. This pattern will, no doubt, endure.

Strategic Calculations

It is easy to blame specific actors of repeatedly advocating Russian terms. But that does not seem to be the complete picture. US administration operates on a principle understood by international relations experts: you cannot win at the negotiating table what you have failed to defend militarily. The American government assumes that it is impossible to pressure the Kremlin to abandon the land that it currently occupies in Ukraine's southern or eastern regions.

The problem is that while recognising this factual reality, US leadership does little to deter Moscow, through statements or actions, from thinking that the current condition will not shift further in its benefit in the near future.

Conflicting Perspectives

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their motivation to agree to terms that does not give them the largest achievable advantage is almost completely absent. There may be multiple initiatives to achieve ceasefire, but they will persist as long as Russia's leadership remains supremely confident in the result.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing lives and land but preventing a entire defensive failure until situations evolve in its favour.

Present Conditions

Factually, there are no genuine requirements for a truce. Now, personal considerations are becoming relevant: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and Kyiv's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any initiative Kyiv finds unacceptable, so that their attention does not shift toward domestic problems. And although their task will now be considerably more difficult after current events, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a only one week to terminate the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, current information leaks, all achieved their purpose.

While new initiatives based on previous concepts are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and demonstrate specific hesitation to change the course of events, if they remain united and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the foreseeable future, primarily depend on ongoing international assistance.
